Independent Auditors

In large jurisdictions, independent auditors are used to investigate allegations of police misconduct. These investigators high law enforcement experience but are not employed by the police department as is the case with internal affairs divisions. They are employed full-time. In investigations in smaller jurisdictions, independent auditors can be appointed by a judge to oversee and investigate a case.

The Delphi Voice Project is exploring the option to have a victims' rights attorney petition the court to appoint an independent auditor. We are attempting to contact a well known retired police detective renown for his ability to solve murder cases to determine if he would be interested in working as a consultant to review the handling of this investigation.

After the conclusion of this project, we may reach out to Indiana state legislators to determine their willingness to sponsor victims' rights legislation that would provide for the appointment of an independent auditor in murder cases that have not been solved after one year.

Also, the release of information to the public by law enforcement should be reviewed by an outside, independent auditor with investigatory experience. Each piece of evidence should be thoroughly assessed independently with regard to several criteria:

1. Its potential to identify the murderer

2. Its potential to compromise a defendant's right to a fair trial.

3. The need to reserve the information to vet any false confessions.

4. Its potential to violate the privacy rights of the victims.

5. The potential harm done to the victims' families by releasing sensational information that will not increase the likelihood of an arrest by public release.
