Indiana provides for the appointment of a special prosecutor under several different circumstances including if:

1. Any party petitions the court and the prosecutor agrees a special prosecutor is needed.

​

2. Any party petitions the court by a verified petition and can show conflict of interest can show, by a preponderence of evidence that the current prosecutor has a conflict of interest.
